Terms of Use

Effective and last updated: 25 August 2026

These Terms of Use (“Terms”) govern access to and use of premium-wine.com.au (the “Website”), operated by Premium Australian Wine Pty Ltd (“Premium Australian Wine”, “we”, “us” or “our”). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Website purpose and agreement

The Website presents information about Premium Australian Wine, Australian wine products, editorial content and ways to contact our team. These Terms apply to website use. A confirmed purchase, trade arrangement, event or other service may also be subject to terms disclosed and accepted for that transaction.

2. Legal drinking age and responsible use

Wine content and alcohol-related products are intended only for adults who are legally permitted to view, enquire about and purchase alcohol in their location. In Australia, you must be at least 18 years old to purchase alcohol. You must not use the Website to facilitate supply to a minor or any unlawful or irresponsible consumption of alcohol.

We support responsible service and consumption. Product descriptions are not health or medical advice, and alcohol should not be consumed where unsafe or prohibited.

3. Product information, pricing and enquiries

We take reasonable care to keep product descriptions, vintages, imagery, availability and prices accurate. Wine presentation, labels, packaging, colour and vintage availability may change, and screen displays may not reproduce colour precisely. Unless expressly stated otherwise, prices are shown in Australian dollars.

Website content and an enquiry response do not by themselves guarantee availability or create a binding sale. A transaction is formed only when we expressly accept it and any applicable price, delivery, age-verification and payment requirements are satisfied. We may correct genuine errors before accepting a transaction.

You are responsible for providing complete and accurate contact, billing, delivery and age-verification information where requested. Delivery, returns and cancellation arrangements will be communicated for an applicable transaction and remain subject to mandatory consumer rights.

4. General information only

Editorial articles, tasting notes, food-pairing ideas, cellaring windows and other Website content are general information and opinion. Taste and storage outcomes vary. You should make your own assessment and obtain professional advice for decisions involving health, law, finance or other specialised matters.

5. Intellectual property

The Website and its original text, design, branding, graphics, photographs, video, software and arrangement are owned by or licensed to Premium Australian Wine and are protected by applicable intellectual-property laws. Third-party trade marks and content remain the property of their respective owners.

We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Website for lawful personal or internal business purposes. You must not reproduce, republish, sell, scrape, systematically extract, modify, reverse engineer or commercially exploit Website content without prior written permission or another legal right.

6. Information you submit

You retain ownership of information you submit. You give us permission to use, reproduce and communicate it only as reasonably necessary to respond, provide the requested service, operate our business, comply with law and exercise legal rights. You warrant that you are authorised to provide the information and that it does not infringe another person’s rights or contain unlawful material.

Personal information is handled under our Privacy Policy.

7. Acceptable use

You must not:

  • use the Website unlawfully, fraudulently or in a way that harms another person;
  • interfere with security, access controls, availability or the operation of the Website;
  • introduce malicious code, probe vulnerabilities or attempt unauthorised access;
  • impersonate another person, misrepresent authority or submit false information;
  • use automated means to overload the Website or extract protected content, except as permitted by us or by law; or
  • use Website content to advertise, endorse or represent an affiliation with us without written permission.

We may restrict access where reasonably necessary to protect the Website, users, our rights or legal compliance.

8. Third-party websites and services

The Website may link to third-party websites or rely on third-party services. A link does not necessarily indicate endorsement or control. Third parties are responsible for their own content, availability, security and terms, and you should review those terms before use.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or another law that cannot lawfully be excluded, restricted or modified. Where our liability can lawfully be limited, it is limited only to the extent permitted by that law.

10. Website availability and changes

We aim to provide a useful and secure Website but do not promise uninterrupted, error-free or continuously available access. We may maintain, change, suspend or discontinue Website features. We may update these Terms by publishing a revised version with a new effective date. Continued use after an update constitutes acceptance to the extent permitted by law.

11. Disclaimers and liability

To the maximum extent permitted by law, the Website is provided on an “as available” basis and we exclude implied terms that may lawfully be excluded. We are not liable for indirect or consequential loss arising solely from Website use, interruption, third-party content or reliance on general editorial information where that loss was not reasonably foreseeable.

This section does not exclude liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct or applicable statutory consumer rights.

12. Severability and waiver

If a provision is invalid or unenforceable, it is read down to the extent necessary or severed, and the remaining provisions continue. A delay in exercising a right is not a waiver of that right.

13. Governing law

These Terms are governed by the laws of South Australia and the Commonwealth of Australia. Subject to any mandatory right to bring a claim elsewhere, the courts of South Australia and competent Commonwealth courts have non-exclusive jurisdiction.
